Welcome to National Children’s Museum. Our www.nationalchildrensmuseum.org website (the “Site”) is comprised of various web pages operated by National Children’s Museum and is designed to bring the organization’s mission—“to inspire children to care about and change the world”—to life, and provides substantive content to a variety of audiences including, children, parents, teachers, and other caregivers. By accessing or using the Site you agree to be bound by the terms, conditions, and notices contained herein and all terms incorporated by reference, (the “Terms”) which the National Children’s Museum may revise at any time. The Terms apply to your access to, and use of, the Site and other websites, mobile sites, mobile applications and other online services that link to the Terms. If you do not agree to all of these terms, do not use the Site.

User agrees to use the Site for lawful purposes only and will not participate in any action that will compromise the security of the Site or damage the Site and their content. National Children’s Museum is not responsible for losses or damage caused by your failure to safeguard your login and password.

Unless otherwise indicated in the Site, the Site and all content and other materials on the Site, including, without limitation, National Children’s Museum’s logo, and all designs, text, graphics, pictures, information, data, software, tools, widgets, sound files, other files and the selection and arrangement thereof (collectively, the “Site Materials”) are the proprietary property of National Children’s Museum or its licensors and are protected under applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-sublicensable license to access and use the Site and the Site Materials for your informational, non-commercial and personal use only. Such license is subject to these Terms and does not include: (a) any resale or commercial use of the Site or the Site Materials therein; (b) the reproduction, distribution, public performance or public display of any Site Materials, except as expressly permitted on the Site; (c) modifying or otherwise making any derivative uses of the Site and the Site Materials, or any portion thereof; (d) use of any data mining, robots or similar data gathering or extraction methods; (e) downloading (other than the page caching) of any portion of the Site, the Site Materials or any information contained therein, except as expressly permitted on the Site; or (f) any use of the Site or the Site Materials other than for its intended purpose. Any use of the Site or the Site Materials other than as specifically authorized herein, without the prior written permission of National Children’s Museum, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms will be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time.

The Linked Sites are not under the control of National Children’s Museum and National Children’s Museum is not responsible for the content of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. National Children’s Museum is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by National Children’s Museum of the site or any association with its operators.

Certain services made available via the Site are delivered by third party sites and organizations. By using any product, service, or functionality originating from the domain, you hereby acknowledge and consent that National Children’s Museum may share such information and data with any third party with whom National Children’s Museum has a contractual relationship to provide the requested product, service or functionality on behalf of users and customers.

You agree to indemnify, defend and hold harmless National Children’s Museum, its respective agents, trustees, officers, directors, employees, successors, and assigns, from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any content you store or otherwise transmit on or through the Site, your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.

THE SITE, SITE MATERIALS, SOFTWARE, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, TITLE AND NON-INFRINGEMENT. National Children’s Museum does not represent or warrant: (a) the Site, Site Materials, software, or services are accurate, complete, reliable, current, or error-free; (b) the functions or services provided by this Site will be uninterrupted, secure, or error-free; or (c) the Site of the server(s) that makes it available are free of viruses or other harmful components.  

National Children’s Museum is not responsible or liable for any third-party services, activities, program, or events included or reference on the Site.

National Children’s Museum reserves the right to update, revise, and delete all content on the Site and any services offered through the Site at any time without notice.

limitation of liability

IN NO EVENT WILL NATIONAL CHILDREN’S MUSEUM OR ITS RESPECTIVE AGENTS, TRUSTEES, OFFICERS, DIRECTORS, EMPLOYEES, SUCCESSORS, AND ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, EVEN IF NATIONAL CHILDREN’S MUSEUM OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

applicable law and venue

These Terms and your use of the Site will be governed by and construed in accordance with the laws of the District of Columbia applicable to agreements made and to be entirely performed within the District of Columbia, without resort to its conflict of law provisions. You agree that any action at law or inequity arising out of or relating to these Terms will be filed only in the state and federal courts located in the District of Columbia, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms.

international users

National Children’s Museum makes no representation that information on this website is appropriate or available for use outside the United States. Those who choose to access this website from outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

termination

Notwithstanding any of these Terms, National Children’s Museum reserves the right, without notice and in its sole discretion, to terminate your license to use the Site, and to block or prevent your access to and use of the Site.
